Terms of Use

1. Agreement
These Terms of Use (the “Terms”) govern your use of Digital Starters, including our website, checkout flow, documentation, private GitHub repository access, support, and related services (the “Service”). By using the Service or buying an access plan, you agree to these Terms.
If you use the Service for a company or client, you represent that you are allowed to accept these Terms for them. If you do not agree, do not use the Service.
2. What Digital Starters Provides
Digital Starters sells fixed-term, non-recurring access to website templates delivered through private GitHub repositories. During your active access period, you may receive access to templates, updates, new releases, documentation, and support as described at checkout.
The template usage rights are governed by our Template License. The short version: you may keep using templates you lawfully clone during active access, but you may not resell, redistribute, share, publish, or use them to create a competing template service.
3. Accounts and GitHub Access
You must provide accurate email, billing, and GitHub information. You are responsible for your account, your GitHub account, and all activity under your access. Do not share private repository access, invitation links, credentials, or private template files with anyone who is not authorized.
GitHub is a third-party service. We are not responsible for GitHub outages, account restrictions, policy changes, or other GitHub issues outside our control.
4. Plans, Payments, and Expiration
Access plans are non-recurring unless checkout clearly says otherwise. When your access period ends, you may lose access to private repositories, future downloads, updates, new releases, and support. You are responsible for any taxes, payment processor fees, currency conversion fees, or similar charges.
5. Refunds
Because Digital Starters provides digital products and private repository access, purchases are generally non-refundable except where required by law or approved by us in our discretion. If we issue a refund, we may immediately revoke repository access, updates, support, and other access-plan benefits.
6. Acceptable Use
You must not:
- misuse, scrape, copy, disrupt, attack, or reverse engineer the Service;
- share private repository contents or access credentials;
- use the Service in violation of law or third-party rights;
- remove required third-party notices from templates or dependencies;
- use Digital Starters materials to operate a competing template marketplace, subscription, starter-kit catalog, or similar service.
7. Support, Updates, and Changes
We may update, replace, remove, rename, or discontinue templates, documentation, features, repositories, pricing, support channels, or access methods. We do not guarantee any specific release schedule, support response time, feature, dependency version, or compatibility update.
8. Privacy and Third-Party Services
We may process information needed to run the Service, such as your email, GitHub username, billing details, access records, and support requests. We may share information with service providers only as reasonably needed for payments, hosting, analytics, delivery, support, security, or legal compliance.
The Service may use third-party providers such as GitHub, Stripe, Lemon Squeezy, Cloudflare, Vercel, Netlify, analytics tools, package registries, and open-source projects. Their services are governed by their own terms and policies.
9. Termination
We may suspend or terminate your access if you violate these Terms, violate the Template License, fail to pay, share private materials, misuse the Service, create risk or liability, or harm the Service or other users. Termination does not limit any other rights or remedies we may have.
10. Disclaimers and Liability Limit
THE SERVICE, WEBSITE, TEMPLATES, DOCUMENTATION, AND SUPPORT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, ACCURACY, AND ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL STARTERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST REVENUE; LOST DATA; BUSINESS INTERRUPTION; OR LOSS OF GOODWILL.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ACCESS PLAN GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE EVENT, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
11. Indemnification
You agree to defend, indemnify, and hold harmless Digital Starters and its owners, operators, contractors, service providers, and affiliates from claims, losses, damages, liabilities, costs, and expenses arising from your use of the Service, your projects or client work, your breach of these Terms, your breach of the Template License, or your violation of law or third-party rights.
12. Changes and General Terms
We may update these Terms by posting a revised version on the website. Your continued use of the Service after changes become effective means you accept the updated Terms. If any part of these Terms is unenforceable, the rest remains in effect. These Terms and the Template License are the entire agreement between you and Digital Starters for the Service.
